Service Authorization & Liability Waiver

Business: Computer Clinic Irvine and its owners, affiliates, subsidiaries, employees, contractors, and vendors (collectively, "Company")

1. Device Condition

Customer acknowledges the device may have pre-existing or hidden damage. Company is not responsible for existing defects or for additional issues that may appear during or after service. A condition report and photos may be taken at check-in.

2. Data & Backup

Customer has been advised to back up all data. Company is not responsible for any data loss, corruption, or inability to recover files. Data recovery is a separate, non-guaranteed service.

3. Repair Risks & Manufacturer Warranty

Opening or servicing may void manufacturer warranties. Normal diagnostic or repair efforts may cause further failure on already damaged or unstable hardware.

4. Limitation of Liability

To the fullest extent permitted by California law, Company's total liability for any claim relating to the device or service is limited to the lesser of (a) the total service fees actually paid to Company or (b) the device's fair market value at the time of service.

Company, its affiliates, officers, employees, contractors, and vendors shall not be liable for:

  • Loss of use, loss of data, loss of profits, business interruption, or any indirect/consequential damages;
  • Loss, theft, or damage caused by burglary, fire, flood, earthquake, water damage, vandalism, power surge, acts of God, or other causes beyond Company's reasonable control;
  • Manufacturer warranty voidance or loss of factory seal. Customer is responsible for maintaining insurance coverage for their property if desired.

5. Warranty on Work

Unless otherwise stated in writing, any warranty is limited to 30 days on parts and labor. Liquid damage, physical damage, misuse, or third-party tampering voids warranty. Parts may be new, used, refurbished, or aftermarket.

California Law: You may request return of replaced parts at the time of authorization (except warranty exchanges).

6. Estimates, Payment & Diagnostic Fee

Estimates may change after full evaluation. Customer authorizes reasonable additional charges necessary to complete the agreed repair. A non-refundable diagnostic/bench fee of $75 applies if repair is declined. Payment in full is due at pickup.

7. Abandoned Devices

Per CA Civil Code §2080, devices left 30 days after notice of completion may be considered abandoned. Company may dispose of, recycle, or sell abandoned devices to recover costs. Storage fees of $75/day apply after 10 days.

8. Privacy & Security

Technicians do not intentionally access personal content but may see data while testing. Customer is responsible for removing sensitive material or supplying access codes if required for proper testing.

9. Hold Harmless / Indemnification

Customer agrees to indemnify and hold harmless Computer Clinic Irvine, its affiliates, officers, employees, contractors, and vendors against any claims, damages, or expenses (including attorney's fees) arising from the service, except for damages directly caused by proven gross negligence or willful misconduct.

10. Authorization

Customer authorizes Company to inspect, diagnose, and repair the device, understanding the risks and limitations stated above.

11. Force Majeure / Risk of Loss

Company shall not be responsible for failure or delay in performance, or for damage, loss, or destruction of the device, due to causes beyond its reasonable control, including but not limited to natural disasters, acts of God, fire, flood, earthquake, theft, vandalism, war, terrorism, civil unrest, or power outage.

12. Governing Law

This Agreement shall be governed by and construed under the laws of the State of California. Venue shall be in Orange County, California.

13. Severability

If any provision is held invalid, the remaining provisions shall remain in full force and effect.
